1. Acceptance of Terms

Welcome to Muzambi. By accessing or using the Muzambi website, mobile application, or purchasing any product or service from us, you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and any additional guidelines or policies applicable to specific services offered on our platform.

These Terms constitute a legally binding agreement between you ("Customer", "User", or "You") and Muzambi Private Limited ("Muzambi", "we", "us", or "our"), a company incorporated under the Companies Act, 2013, with its registered office in Kerala, India.

  If you do not agree to these Terms, please discontinue use of our platform immediately. Continued use following any amendment to these Terms constitutes acceptance of the revised Terms.

 

2. Definitions

"Platform" refers to the Muzambi website, mobile application, and all associated digital properties.

"Products" means mobile phones, laptops, tablets, accessories, and any other electronic goods listed for sale on our platform.

"Order" means a confirmed purchase request submitted by you for one or more Products available on our platform.

"Account" means the registered user profile created by you on our platform to access and use our services.

"Brand Partners" refers to manufacturers and technology companies whose products are listed on our platform, including Samsung, Apple, Oppo, Vivo, HP, Lenovo, and others.

 

3. Eligibility

To use our platform and place orders, you must meet the following criteria:

  • You must be at least 18 years of age
  • You must be legally capable of entering into a binding contract under the Indian Contract Act, 1872
  • You must provide accurate, current, and complete information during registration and at checkout
  • You must not be prohibited from purchasing electronic goods under any applicable law or regulation in India

 

If you are below 18 years of age, you may use the platform only under the supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

 

4. User Account

4.1 Registration

To access certain features of our platform, you may be required to create an account. You agree to provide accurate and complete information and to update such information to keep it current at all times.

 

4.2 Account Security

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

  • Choose a strong password and not share it with any third party
  • Notify us immediately at info@muzambi.com if you suspect any unauthorised access to your account
  • Ensure you log out of your account after each session, particularly on shared devices

 

Muzambi shall not be liable for any loss or damage arising from your failure to maintain account security.

 

4.3 Account Suspension

We reserve the right to suspend or permanently terminate your account without prior notice if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused our platform in any way.

 

5. Product Listings and Pricing

5.1 Product Descriptions

We make every effort to ensure that product descriptions, specifications, images, and other information on our platform are accurate and up to date. However, we do not warrant that product descriptions or other content are free from errors or omissions. Product images are for illustrative purposes only and may vary slightly from the actual product.

 

5.2 Pricing

All prices displayed on our platform are in Indian Rupees (INR) and are inclusive of applicable GST unless stated otherwise. Muzambi reserves the right to modify product prices at any time without prior notice. The price applicable to your order will be the price displayed at the time of checkout confirmation.

  In the event of a pricing error, we reserve the right to cancel the order and refund the amount paid, even after order confirmation.

 

5.3 Product Availability

All orders are subject to product availability. If a product becomes unavailable after you have placed an order, we will notify you promptly and offer a full refund or alternative product options.

 

5.4 Brand Partner Products

Products sold under brands such as Samsung, Apple, Oppo, Vivo, HP, and Lenovo are subject to the respective manufacturer's warranty terms and conditions. Muzambi acts as an authorised reseller and is not responsible for any manufacturer warranty claims beyond facilitating the process.

 

6. Ordering and Payment

6.1 Placing an Order

By placing an order on our platform, you make an offer to purchase the selected product at the displayed price. Your order is confirmed only upon receipt of a confirmation email or SMS from Muzambi. We reserve the right to accept or reject any order at our sole discretion.

 

6.2 Payment Methods

We accept the following payment methods:

  • Credit and debit cards (Visa, MasterCard, RuPay)
  • Net banking
  • UPI (Unified Payments Interface)
  • EMI options via applicable bank and NBFC partners
  • Wallets (PhonePe, Google Pay, Paytm, and others)
  • Cash on Delivery (available for select pin codes and order values)

 

6.3 Payment Security

All online payments are processed through secure, PCI-DSS compliant payment gateways. Muzambi does not store your full card details on our servers. In the event of a failed or declined transaction, please contact your bank or payment provider.

 

6.4 GST Invoice

A valid GST tax invoice will be provided for every purchase made on our platform. This invoice will be delivered digitally to your registered email address and will also be available for download from your account dashboard.

 

7. Shipping and Delivery

7.1 Delivery Timelines

Estimated delivery timelines will be displayed on the product page and at checkout. Delivery timelines are indicative and not guaranteed. Actual delivery may vary depending on your location, product availability, and logistics partner operations.

 

7.2 Delivery Charges

Applicable shipping charges, if any, will be clearly displayed at checkout before you confirm your order. Free delivery may be offered on orders above a specified minimum order value, as communicated on the platform.

 

7.3 Delivery Address

You are responsible for providing a complete and accurate delivery address. Muzambi shall not be liable for failed or delayed deliveries resulting from incorrect or incomplete address information provided by you.

 

7.4 Risk of Loss

Risk of loss and damage to products transfers to you upon delivery to the address provided at checkout. Please inspect your order upon receipt and report any visible damage to the packaging or product within 24 hours to info@muzambi.com or +91 6238903030.

 

8. Returns and Replacement Policy

8.1 Return Eligibility

You may request a return or replacement within 7 days of delivery for the following reasons:

  • Product received is physically damaged or defective
  • Product received is different from what was ordered (wrong model, colour, or variant)
  • Product is non-functional out of the box

 

  Change of mind, buyer's remorse, or preference for a different product do not qualify as valid reasons for return unless otherwise communicated in a specific product offer.

 

8.2 Return Conditions

To be eligible for a return or replacement, the following conditions must be met:

  • Product must be in its original, unused condition with all accessories, manuals, and packaging intact
  • Return request must be raised within 7 days of delivery via email to info@muzambi.com or by calling +91 6238903030
  • The product must not have been tampered with, repaired, or modified in any way
  • IMEI/serial number of the product must match the original invoice

 

8.3 Return Process

  1. Submit a return request to info@muzambi.com with your order number, reason for return, and photographs of the defective or incorrect product
  2. Our customer support team will review your request within 48 business hours
  3. Upon approval, a reverse pickup will be scheduled through our logistics partner
  4. Once the product is received and inspected at our warehouse, a replacement or refund will be processed within 7 to 10 business days

 

8.4 Non-Returnable Products

The following products are not eligible for return or replacement:

  • Products damaged due to customer misuse, negligence, or accident
  • Products with removed, tampered, or missing IMEI stickers or serial numbers
  • Software, digital downloads, and prepaid services
  • Products specifically marked as non-returnable on the product page

 

9. Refund Policy

Refunds will be processed in the following circumstances:

  • Approved return requests where replacement is unavailable
  • Order cancellation before shipment is dispatched
  • Undelivered orders due to logistics failure
  • Duplicate payment due to technical error

 

9.1 Refund Timeline

Once a refund is approved and initiated by Muzambi, it will be credited back to the original payment source within the following timelines:

  • UPI / Wallets: 2 to 3 business days
  • Credit Card / Debit Card: 5 to 7 business days (subject to bank processing)
  • Net Banking: 3 to 5 business days
  • Cash on Delivery orders: Refund processed via bank transfer to the account details provided by you, within 7 to 10 business days

 

Muzambi is not responsible for delays caused by your bank or payment provider. Please contact your bank if the refund is not reflected within the specified timeline.

 

10. Warranty

All products sold on Muzambi come with the manufacturer's standard warranty. Warranty terms, duration, and coverage vary by brand and product category.

  • Manufacturer warranty claims must be directed to the respective brand's authorised service centres
  • Muzambi will assist in facilitating warranty-related communication with brand partners upon request
  • Warranty does not cover damage caused by misuse, physical damage, liquid exposure, or unauthorised repair
  • Extended warranty plans, where offered, are governed by the terms of the respective warranty service provider

11. Order Cancellations

You may cancel your order subject to the following conditions:

  • Orders can be cancelled before the shipment is dispatched. Once dispatched, cancellation is not possible
  • To cancel an order, contact us at info@muzambi.com or +91 6238903030 with your Order ID
  • For prepaid orders, the refund will be processed to the original payment source within 5 to 7 business days
  • Muzambi reserves the right to cancel any order due to pricing errors, stock unavailability, suspected fraud, or non-serviceability of the delivery location

 

In case Muzambi cancels your order, you will be notified via email or SMS and a full refund will be issued.

 

12. Intellectual Property Rights

All content on the Muzambi platform, including but not limited to text, graphics, logos, product images, interface designs, software, and trademarks, is the exclusive property of Muzambi Private Limited or its licensors. All rights are reserved.

You are granted a limited, non-exclusive, non-transferable licence to access and use our platform for personal, non-commercial purposes only. You may not:

  • Copy, reproduce, or redistribute any content from our platform without prior written permission
  • Use our brand name, logo, or trademarks in any manner that suggests endorsement or affiliation
  • Scrape, crawl, or extract data from our platform using automated tools
  • Reverse engineer, decompile, or attempt to derive the source code of our software

 

13. Prohibited Conduct

You agree not to engage in any of the following activities on or in connection with our platform:

  1. Impersonating any person or entity or misrepresenting your affiliation with any person or entity
  2. Using the platform for any unlawful, fraudulent, or malicious purpose
  3. Submitting false, misleading, or defamatory product reviews or ratings
  4. Attempting to gain unauthorised access to other user accounts, our servers, or any third-party systems
  5. Uploading or transmitting any viruses, malware, or other malicious code
  6. Engaging in bulk purchasing for resale purposes without prior written authorisation from Muzambi
  7. Harassing, threatening, or abusing our customer support staff or other users
  8. Placing fraudulent orders or providing false delivery address information

 

Violation of any of the above may result in immediate account suspension, cancellation of pending orders, and legal action where warranted.

 

14. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Muzambi shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from your use of our platform or products
  • Loss of data, revenue, profits, or business opportunities resulting from platform downtime or technical errors
  • Delays in delivery caused by force majeure events including natural disasters, government restrictions, or carrier failures
  • Product defects or failures that are the responsibility of the manufacturer or brand partner

 

In all cases, Muzambi's maximum aggregate liability to you in connection with any claim arising from these Terms shall not exceed the total amount paid by you for the specific order giving rise to the claim.

 

15. Indemnification

You agree to indemnify, defend, and hold harmless Muzambi Private Limited, its directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your violation of these Terms and Conditions
  • Your misuse of our platform or products
  • Your infringement of any third-party rights including intellectual property rights
  • Any false, misleading, or inaccurate information provided by you on our platform

 

16. Platform Availability

We strive to maintain continuous availability of our platform; however, we do not guarantee uninterrupted access. The platform may be temporarily unavailable due to scheduled maintenance, technical upgrades, server issues, or circumstances beyond our control.

Muzambi shall not be held liable for any inconvenience, loss of business, or financial loss arising from planned or unplanned platform downtime.

 

17. Third-Party Services and Links

Our platform may integrate with or link to third-party services including payment gateways, logistics providers, social media platforms, and brand partner portals. These third-party services are governed by their own terms and privacy policies.

Muzambi does not endorse or assume responsibility for any third-party content, products, or services. Your use of third-party services is at your own risk.

 

18. Dispute Resolution

18.1 Informal Resolution

In the event of any dispute, claim, or grievance arising from these Terms or your use of our platform, we encourage you to contact us first at info@muzambi.com. Our customer support team will make every effort to resolve the matter amicably within 15 business days.

 

18.2 Consumer Forum

Nothing in these Terms limits your rights to approach a Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019, if you are dissatisfied with our resolution.

 

18.3 Arbitration

For disputes not resolved through informal means, both parties agree to resolve the matter through binding arbitration conducted in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English and the seat of arbitration shall be Kerala, India.

 

19. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Subject to the arbitration clause above, any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Kerala, India.

 

20. Amendments to These Terms

Muzambi reserves the right to revise, update, or replace these Terms at any time. Changes will take effect upon posting to our platform. We will provide reasonable notice of material changes via email or a prominent notice on our platform.

Your continued use of our platform after any amendment constitutes your acceptance of the updated Terms. We recommend reviewing this page periodically to stay informed of any changes.

 

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.
